China imposes anti-circumvention measures on imported related optical fiber products originating in the United States

 On September 3, the Ministry of Commerce issued a new announcement, announcing the results of the anti-circumvention investigation on the import of certain single- optical fibers with shifted cutoff wavelengths originating in the United States.

The Ministry of Commerce ruled that U.S. optical fiber manufacturers and exporters exported the relevant cutoff wavelength shifted single-mode fiber (G.654.C fiber) to China by changing the trade mode, which did not have sufficient commercial rationality, weakened the implementation effect of the existing anti-dumping measures, and constituted circumvention of the anti-dumping measures on the import of non-dispersion shifted single-mode fiber originating in the United States. Based on the results of the investigation, the Ministry of Commerce submitted a proposal to the Tariff Commission of the State Council to adjust the scope of taxation. According to the proposal of the Ministry of Commerce, the Tariff Commission of the State Council made a decision, in accordance with the relevant provisions of Article 49 of the "Foreign Trade Law of the People's Republic of China", Article 54 of the "Tariff Law of the People's Republic of China" and Article 55 of the "Anti-Dumping Regulations of the People's Republic of China", from September 4, 2025, the current anti-dumping duty rate on imported non-dispersion shifted single-mode fiber originating in the United States shall apply to the import of relevant cutoff wavelength shifted single-mode fiber originating in the United States.

The anti-dumping duty rates for each company are as follows: Corning Incorporated is 37.9%; OFS-Fit, LLC is 33.3%; Draka Communications Americas, Inc. is 78.2%; and other U.S. companies are 78.2. The implementation period of the anti-circumvention measures for imports of the relevant single-mode optical fiber with a cutoff wavelength shifted from the United States shall be from 4, 2025, to April 21, 2028, i.e., the expiration date of the anti-dumping measures for of the non-dispersion-shifted single-mode optical fiber from the United States. On September 4, the Ministry of Commerce's news spokesperson answered reporters questions on the anti-circumvention investigation ruling on imports of relevant optical fiber products from the United States. The spokesperson stated that on March 4, 2025 at the request of domestic enterprises, the Ministry of Commerce initiated an anti-circumvention investigation into imports of relevant cutoff wavelength shifted single-mode optical fiber products from the United. This case is China's first anti-circumvention investigation.

Upon case filing, the Ministry of Commerce conducted an investigation in accordance with the law and regulations, and the investigation procedures were open and transparent, safeguarding the rights of all interested parties. Through the investigation, the evidence showed that US exporters avoided China's anti-dumping measures on non-dispersive shifted-mode optical fibers to the US by exporting related cutoff wavelength shifted single-mode optical fibers to China. Based on the results of the investigation, the Ministry of Commerce issued an, deciding to implement anti-circumvention measures from September 4, 2025. Data show that non-dispersive shifted single-mode optical, commonly known as G.652 optical fibers or G.652 single-mode optical fibers, have the advantages of low internal loss, large bandwidth, easy upgrade expansion, and low cost, and can be widely used in high-speed, long-distance transmission, such as long-distance communication, trunk lines, cable television, and looper networks.
